The Online Store www.ttpack.com.pl (hereinafter referred to as ‘’Store’’) allows you to make distance purchases via the Internet, as described in the following Terms and Conditions.

Products that are available are presented and described on the website of the Store. Given prices are net prices, and shipping costs are provided, according to chosen option separately, unless the shipping cost will be covered by the Seller because of the value of the order.
Products that are in stock at the moment are marked as available and possible to be purchased according to provisions stated in these Terms and Conditions.
Products that are not in stock are marked as ‘’Awaiting for arrival’’. Their ordering is possible on based on individually set conditions after the previous contact with the Seller.
The Seller is obliged to deliver the purchased items without defects. The products that are offered to customers are new and originally packed.

Term "consumer" is understood as a natural person who has entered into an Agreement of Sale with the Seller without a direct connection with the business or professional activity.
By using the Store you are obligated to:
not providing or forwarding content prohibited by law, such as content that promotes violence, defamatory or violates personal rights and other rights of third parties;
not disturbing its functioning;
not taking actions such as: sending or placing unsolicited commercial information (spam) in the behalf of the Store;
use the Store with accordance to the provisions of the law in force on the territory of the Republic of Poland, the provisions of the Terms and Conditions, as well as the general principles of using the Internet.
To submit an order in the Store you need to have an e-mail and turn on the function of accepting cookie files (functional) in the web browser as well as pop-up windows.
Submission of an order takes place by fulfilling the following steps:
choosing Products you would like and adding them to the cart;
opening the order page presented in the menu with a shopping cart symbol, where the summary of the chosen items and their prices are showed;
choosing and shopping option by registration of your own user account or as a guest;
filling a form by providing necessary personal and address data;
choosing a delivery method of purchased products;
choosing a payment method;
confirmation of an order by clicking on the ‘’Order with the obligation to pay’’ button.
If the data provided by you during the process of completing the order is incorrect, The Store will contact you via e-mail or phone in order to current them if such contact will be possible.
The Store will inform you through a notification on the website and sending an e-mail about a positive verification of the provided data and confirmation of order acceptance. At the time of sending the message the agreement of sale between you and the Seller is concluded. The message will contain the data necessary to make payment according to the chosen payment method as well as the payment due date.
In the case of payment with a bank transfer in the Przelewy24 system and the PayPal system payment, you will be redirected to the appropriate website in order make the payment immediately after completing the order.
The discount in the Store can be used only the registered users.
The Store has quantity discounts described on the pages of specific products.
Discount coupons - in order to use them you have to log in to your account in the TTpack Store. Enter the DISCOUNT CODE in the appropriate field. The code can be used only once on one account unless it is a reusable code. For the customers, that already used the code we have an alternative offer, you can give the code to your friend.
To pay for the ordered products you may use the following payment methods:
bank transfer to the Seller’s bank account, including the use of the Przelewy24 system,
payment in the PayPal system,
cash on delivery
payment with cash or credit card during self-pick-up
payment during picking up a package from Paczkomaty.
The bank transfer and the payment in the PayPal system should be made within 3 days from the conclusion of the Agreement of Sale.

Cash payment should be made on delivery, and in case of the self-pick-up during the pick-up that should take place within 3 days from the conclusion of the Agreement of Sale.
Delivery and Pick-up
In case of choosing to pay with a bank transfer or in the PayPal system the ordered products are sent within 24 hours (business days) from the moment of receiving the payment by the Seller unless you decide for self-pick-up.
In case of choosing to pay on delivery, it will be sent within 24 hours (business days) from the day of sending the message confirming the acceptance of the order.

Shipping cost is provided each time before submitting an order and does not include any additional fees.
The Sellers informs on the Store’s website about the total purchase amount, the exceeding of which is rewarded with a free delivery. In such case, the full shipping cost is borne by the Seller about which you will be informed on the order page after clicking on the shopping cart icon in the website menu.
If you purchased a product as a consumer and it is to be sent by the Seller, the risk of accidental loss or damage passes on you at the moment of delivery. However, in a situation, if you wish the use services of a different carrier than the one offered by the Seller, the risk passes on the customer at the moment of giving in to the courier.
If you purchased a product as a consumer, the Seller will deliver a confirmation of Agreement of sale in a paper form together with the order. The confirmation content is an information about the acceptance of the order and the text of this Terms and Conditions.
The purchased items are always coming with a receipt or VAT invoice on a request.
If according to you the purchased item is defective, you can use the rights of the warranty, in accordance with the current provisions of the Polish law.
Please submit the complaint via mail by returning the products along with a written description of the defect and the requests towards the Seller.
If the product with a defect was purchased as a consumer you have the possibility to request from a Seller:
Its repaid of a replacement for a new one;
Lowering the price (in a proportion appropriate to the loss of value);
Withdrawal from the contract (if the defect is major).
on the terms set by the currently applicable provisions of the Polish Civil Code.
You will immediately receive the information about the method of processing your complaint. Lack of response to your complaint as a Consumer within 14 days means that the request is considered as justified.
Repairs and replacement will be made immediately, in order not to cause excessive inconvenience on your part.
If the complaint is considered as justified, the shipping cost will be borne by the Seller who may ask you to show you the confirmation of the shipping cost.
Withdrawal from the agreement
If you purchased a product as a consumer, there is a possibility of withdrawal from the Agreement of Sale within 14 days of receiving the order with accordance to the Act of 24 June 2014 on Consumer Rights.
The right to withdrawal from the agreement does not apply in relation to the products that were delivered in a sealed package, which after the opening of the packaging cannot be returned due to the protection of health or for hygienic reasons if the packaging was opened after delivery.
In case of withdrawal from the above-mentioned agreement we will return all payments that we received from you, including the cost of shipping (excluding additional costs coming from choosing shipping methods other than the cheapest one that we are offering), immediately, and in each case not longer than within 14 days from the day when we were informed about your decision to withdrawal from the above-mentioned agreement.
Use of personal data
By purchasing goods in the Store you agree that the data required to create the user account or the order form are going to be used by the Seller in order to document the sale and processing of the order. Your data may also be transferred to entities providing transport services for the delivery of purchased products.
In case of your consent to receive information about sales and new arrivals in the Store’s offer as well as receiving offers from Store’s partners, such information will be sent by electronic means in form of a message to the e-mail address you provided. The consent can be withdrawn by you at any time.
Within the implementation of the Agreement of Sale with the Buyer, the Store is authorized to send an invitation to complete an after-sale survey to the e-mail address provided by the Buyer. The survey is used to learn to know the opinion about the transaction. The participation in the survey is voluntary.
At any time you have a right to access, correct, update or delete your data using the options available on your account or by contacting the Seller.
In order to send the surveys related to the customer’s satisfaction with a purchase made in the store as a part of the ‘’Trusted Reviews’’ via electronic means, I agree to transfer my personal data, including e-mail address and information about the purchase made in the Tommy Café Store to Ceneo Sp. z o.o. with headquarters in Poznan, 60-166 Poznan, ul. Grunwaldzka 182 and their processing by Ceneo.
Out-of-court dispute resolution
If you have purchased a product as a consumer, there is a possibility of use of out-of-court complaint and disputes resolution.
Detailed information on the possibility of use of the out-of-court complaint and disputes resolutions as well as access to these procedures are available in offices or websites of the poviat or municipal consumer ombudsmen, social organizations, whose statutory tasks include consumer protection Voivodship Inspectors of Trade Inspection and websites of Office of Competition and Consumer Protections:
As consumers, you have, among others the following possibilities of using out-of-court means of dealing with complaints and disputes:
Appealing to The Permanent Arbitration Consumer Court operating with the Trade Inspection with a request to settle the dispute arising from the concluded agreement of sale;
Appealing to the Voivodship Trade Inspection inspector to initiate a mediation proceeding regarding the amicable settlement of the dispute.
In matters not covered by these Terms and Conditions, the generally applicable provisions of Polish law shall apply.
Any possible disputes arising between the Client that is not a customer and the Seller shall be settled by the District Court in Bielsko-Biala, depending on the subject of the dispute and in accordance with the provisions on material and functional jurisdiction.
